ATTESTATION OF WILL

Consulate General of India serves the states of Illinois, Indiana, Iowa, Michigan, Minnesota, Missouri, North Dakota, South Dakota, Wisconsin. Only the applicants residing in these states are eligible to apply at this Consulate.

Any queries / clarifications regarding ‘Attestation of Will’ may please be sent at email address : cons.chicago@mea.gov.in with the subject “Miscellaneous Services – Attestation of Will”. The applicants must provide full facts and details of the case while writing the e-mail. The applicants are also required to provide their complete contact details (along-with their reachable contact number) so that they may be contacted accordingly while addressing their issues.

The applicant drawing up the Will is required to come to the Consulate in person and would be interviewed by the Consular Officer before attestation of the Will. There is no relaxation to this rule.

In case of applicant holding nationality other than Indian, the Consulate will attest the Will only after it has been apostilled by the State Department or the concerned Embassy / Consulate of the applicant in USA. Document can be Apostilled at the Office of the Secretary of State where the applicant resides. However, there is no need for Will to be apostilled for OCI/PIO card holders. Such applicants may enclose a copy of their OCI/PIO while applying.

Will of a dead person will not be attested at the Consulate. Will of a mentally incapacitated person will not be accepted. Such cases will be entertained only if applicant has notarized judicial orders of guardianship of the person who is the main executor of the Will.

How to Apply:

1. Download the Miscellaneous Application form and fill it up carefully. Each applicant is required to fill up separate Miscellaneous Application form and affix his/her photograph on the same.
2. The Will document to be attested should be presented in original and submitted with following: (i) applicant will sign on the WILL as per signature on his/her recent valid passport; (ii) a recent passport size color photo of the applicant affixed on the WILL; (iii) full name, contact address and signatures of two local witnesses (other than family members). If witnesses are not coming in person to the Consulate, their signatures should be DULY NOTARISED.
3. Applicant’s current valid passport in original and its photocopy. Those having Indian passport may provide original and photocopies of the first five pages and last two pages of the passport. Original and photocopy of the document showing valid US visa status.
4. Original and photocopy of any of the following documents as proof of residence: US Driving License, Utility Bill, Lease Agreement, State Identity Card, Mortgage Deed, or State Identification Card.
5. Carry all original supporting documents for presentation to the Consular Officer. Photocopies of these documents may be attached with the application. Ensure that photocopies of these documents are legible.
6. Fee: A fee of US$20.00 (Twenty Only) per attestation and an additional fee of US$2.00 (Two Only) towards Indian Community Welfare Fund (ICWF). The fees should be paid in cash or as two separate money orders / cashiers’ cheque, drawn in favour of 'Consulate General of India, Chicago’. Personal cheques, personal money orders, debit / credit cards and other banking instruments are not accepted. 
7. Processing Time: Same day, however, if unforeseen technical reasons occur, services can be delayed till those problems are resolved.
